Cattery «SharmMuar» reg. WCF number RU-10815-2016 in the person of the breeder Barabash Alena Vasilievna (hereinafter referred to as the Seller) and the kennel "..." in the person of the manufacturer ... (hereinafter referred to as the Buyer) have concluded this agreement as follows

 

Subject of the contract.

 

1. The buyer acquires the rights of the owner, and the seller sells the maine coon kitten

2. On the day of sale, the Animal corresponds to the following class

 

BREED - for breeding and is transferred to the Buyer in the kennel "..." for breeding by a closed producer.

 

3. This agreement is made in accordance with the requirements of Art. 160, 161, 492, 497, CCU 500 into two copies, one for each of the sides having the same legal effect, and is effective from the moment it is signed by both parties. Notarization of the agreement is required.

 

4. The responsibility of the parties is established by this Treaty and the current legislation of the Russian Federation. All disputes arising between the parties are resolved through negotiations. If the consent is not reached, the dispute is subject to review in accordance with the current legislation of the Russian Federation in the courts of general jurisdiction in the residence of the Seller

 

Conditions of the Sale

 

1. The seller guarantees that at the time of sale the Animal is completely healthy, has no signs of viral diseases.

 

2. The buyer has the right to check his health in a veterinary clinic with a state license within 5 (five) days after the day of purchase of the Animal at his own expense. The Seller agrees to take back the Animal and upon agreement of the parties in exchange to provide an equivalent Animal after the presentation by the Buyer of a proper veterinary certificate confirming the ill health of the Animal at the time of purchase, without taking into account the amount spent by the Buyer for the maintenance of the Animal and its transportation. The causes of the disease associated with improper transportation, improper feeding, or improper maintenance of the animal by the Buyer after its acquisition is excluded. All disputable issues, such as the delivery of tests, laboratory tests, diagnostics and others, are resolved only in the presence of the Seller or his Representative, and the time and place of the necessary studies are agreed in advance. If the Buyer has not exercised the right given to him by this clause of the Agreement, further claims for Animal Health by the Seller shall not be accepted.

 

3. In all cases, including the personal problems of the Buyer, the pet allergy and his family members, the animal's injury, illness for more than 5 days from the date of purchase, and other cases other than those described in clause 2 of this contract, the Seller may accept the Animal back, but without refunding the cost and without replacing the Animal, or assist in finding another Buyer.

 

4. If the Buyer didn’t use the right in clause 2, claims for the animal's health condition will not be accepted in the future. The replacement of the Animal after the 5-day warranty given by the Seller is excluded. For the further health of the Animal, the Buyer is fully responsible.

 

5. At the time of activation of the Animal, the chairman of the club confirmed that the animal does not have disqualified signs.

 

6. The seller guarantees the conformity of the Animal to the quality specified in this Agreement at the time of sale and does not give any guarantees for the future regarding the exhibition career and reproductive qualities of the Animal.

 

7. The seller undertakes to provide advice in matters of maintenance, upbringing, breeding, preparation of the Animal for the exhibition.

 

8. The Buyer can’t sell an animal to a store or market for resale, a pet shelter, a research laboratory. And also resold, given, leased or donated without the Seller's written consent with the obligatory provision of the full name and contact details (address, phone) of new owners until the moment of transfer to them of the Animal.

 

9. In case of unwillingness or refusal of the Buyer to continue keeping the Animal, the Breeder may take it back. At the same time, the amount spent for its maintenance and acquisition is not compensated.

 

10. If the Seller becomes aware of the sale of kittens without documents for breeding from this Animal, about the bad physical condition or the bad state of the Animal, or about the facts of ill-treatment, the Animal with all registration documents is subject to immediate return to the Seller without compensation of the funds previously paid by the Buyer.

 

11. The buyer undertakes to conscientiously maintain the animal, provide care recommended by the seller, a balanced diet, and regular scheduled vaccination and deworming, exclude access to the unglazed balcony, access to open windows or uncontrolled access to the street. The buyer undertakes to provide the animal with the necessary veterinary assistance. If the veterinary assistance was not provided in time, the Seller does not accept claims for Animal Health.

 

12. The buyer agrees not to keep the animal in the cage, except for cases of necessary quarantine, the necessity and cause of which must be confirmed and proved by the conclusion of a state or private licensed veterinary clinic.

 

13. The buyer undertakes to give the animal time to communicate, provide it with toys, do not leave it for a long time alone. The animal must have proper and inherent care, a proper food ration, which includes the use dry fodder not lower than the Premium class or the quality natural food recommended by the Seller. If necessary, timely and high-quality veterinary care.

 

14. The buyer undertakes not to carry out the operation for the removal of claws by the animal, because this cruel operation brings an injury to the animal, negatively affects his health and behavior.

 

15. In case of Animal Disease, the Buyer must inform the Seller and accept its recommendations, and to show the animal to the veterinarian.

 

16. The Seller and the Buyer have the right to use for advertising purposes the photographs of this Animal, both those made before the purchase and after, by whomever these photos are taken, except photos with protected rights.

 

17. Any video, photo and text information about the Animal, published by the Buyer in the media, on Internet sites and forums should contain the full name of the Animal with the obligatory indication of its breed.

 

18. All information about the activities of the cattery , received as a result of communication between the Buyer and the Seller (written and verbal), is confidential and should not be transferred to third parties, be covered in the media, Internet resources and forums.

 

If there are conflict situations, the Buyer has no right to submit them for public discussion - the Internet, forums, television. Also, other people can not do this at the request of the buyer. Conflict situations can be resolved only between the Buyer and the Seller. For violation of this clause of the contract a fine of 100,000 rubles (one hundred thousand rubles). And also a fine of 3000 euros is levied in court.

 

19. The Seller and the Cattery are not responsible for the sale of the Animal with undetected defects, deficiencies and genetic diseases that cannot be detected at the time of the actuation.

 

20. If the Buyer has other animals in the house, three-week quarantine is necessary for the kitten. With the joint maintenance of animals without a quarantine period, claims for the health of the kitten are not accepted.

 

 

For kittens sold in breeding

1. The buyer undertakes not to pair the cat for up to 10 months. A cat can have no more than 3 parturitions in 2 years.

 

2. The animal is purchased with the possibility of breeding as a closed producer. This cat is closed to foreign mating. The mattings of this cat must occur only in the cattery of the Buyer with cats that are in the full ownership of the Buyer. The remaining cases should be negotiated with the Seller of this cat and occur only with his written consent.

 

3. All the kittens received as a result of the animal's mattings can not be sold, donated, leased, given in payment for something, exchanged, given for co-ownership, etc. in the Chelyabinsk region in breeding.

 

4. Any descendant of this Animal must be sold with the Contract and Registration Documents

 

5. All kittens from this animal are sold for breeding only in registered nurseries having a good reputation, only as closed producers.

 

6. The buyer undertakes not to sell in breeding kittens from this Animal to nurseries: 

 

Silver Aqualion (Alexandrova Irina), Ekb-coon (Alekseeva Elena), Pet Palace (Shulgina Irena), DeniLars (Denisyuk Larissa), LinaVanLinx (Ivanova Evelina), Sansaverina Gold (Repina Ekaterina), Wariwat (Sarina Tatiana), PawWinner (Hlistunova Galina), Valentina Egorova (Poletaeva). 

 

This prohibition applies to the subsequent sale of any descendants of kittens from this Animal.

 

7. Kittens sold under castration from this Animal must be castrate before leaving for a new home.

 

Payment of the transaction

The cost of the Animal under this Agreement is … euros (… euros)

The costs for sending the animal to another city / country (including veterinary certificate, transportation, transportation costs) are paid by the Buyer additionally under a separate arrangement and are not included in the cost of the Animal.                                                                          

In the case of sending an animal through a courier to another city / country, the day of the receipt of the Animal is considered to be the day of the transfer of the Animal to the courier.

Responsibility for the life and health of the kitten is attached by the courier for delivery.

When reserving an Animal, the Buyer deposits a deposit of … euros (… euros).

The buyer must pick up the Animal and pay the remaining value of the Animal in the amount of … euros (… euros) until ... (…).

 

 

• If the Buyer has not paid for and collected the Animal before the specified time and does not get in touch, the Seller has the right to consider this as the Buyer's refusal to purchase the Animal. The animal can be sold to another person without returning the deposit to the Buyer. 

• If the Buyer is unable to pick up the Animal within the agreed time, he shall notify the Seller of this fact in writing. Keeping the Animal in the Seller's cattery with (...) will be paid, at the rate of 25€ for each day of keeping.

• The Seller disclaims responsibility for the life and health of the Animal with (...). All responsibility for the life and health of the Animal passes to the Buyer, despite the fact that the Animal is paid for by the Seller.

 

The deposit in case of refusal from the Animal is not returned.

If, due to the fault of the Seller, the animal can not be transferred to the Buyer (death, injury or other cause), the deposit is not refundable. The buyer has the right to choose another Animal of the same breeding class and type or reserve the right to choose an Animal from another pair.

Питомник «SharmMuar» рег. номер WCF № RU-10815-2016 в лице заводчика Барабаш Алёны Васильевны (именуемый в дальнейшем Продавец) и питомник «...» в лице заводчика ... (именуемый в дальнейшем Покупатель) заключили настоящий договор о нижеследующем

 

Предмет договора.

 

1. Покупатель на правах собственника приобретает, а Продавец продает котенка мейн-кун

2. На день продажи Животное соответствует следующему классу

 

BREED – для племенного разведения и передается Покупателю в питомник «...» для племенного разведения закрытым производителем. Исключается продажа потомков от данного Животного (... SharmMuar) в Уральский регион - Челябинская, Свердловская области, а также Пермский край.

 

3. Настоящий Договор составлен в соответствии с требованиями ст.ст. 160,161, 492, 497 и 500 ГК РФ в двух экземплярах, по одному для каждой из сторон, имеющих одинаковую юридическую силу, вступает в силу с момента подписания его обеими сторонами. Нотариальное заверение Договора не требуется.

 

4. Ответственность сторон установлена настоящим Договором и действующим законодательством Российской Федерации. Все споры, возникающие между сторонами, разрешаются путем переговоров. При не достижении согласия спор подлежит рассмотрению в соответствии с действующим законодательством РФ в судах общей инстанции по месту жительства Продавца

 

Условия продажи Животного

1. Продавец гарантирует, что на момент продажи Животное полностью здорово, отсутствуют признаки вирусных заболеваний.   

                                                                 

2. Покупатель вправе в течение 5 (пяти) суток после дня приобретения Животного за свой счет проверить его здоровье в ветеринарной клинике, имеющей государственную лицензию. Продавец обязуется принять назад Животное и по договорённости сторон в обмен предоставить равноценное Животное после предъявления Покупателем надлежащего ветеринарного заключения, подтверждающего нездоровье Животного на момент приобретения, без учета суммы, потраченной Покупателем на содержание Животного и его транспортировку. Исключаются причины заболевания, связанные с неправильной транспортировкой, неправильным кормлением или неправильным содержанием животного Покупателем после его приобретения. Все спорные вопросы, такие как сдача анализов, лабораторные исследования, диагностика и прочие, решаются только в присутствии Продавца или его Представителя, при этом время и место проведения необходимых исследований согласовываются заранее. Если Покупатель не воспользовался правом, данным ему настоящим пунктом Договора, дальнейшие претензии по здоровью Животного Продавцом не принимаются.

 

3. Во всех случаях, включающих личные проблемы Покупателя, аллергию на животное у Покупателя и членов его семьи, травмы животного, болезни в период более 5 дней с момента приобретения и прочих случаях, кроме описанных в п. 2 настоящего договора, Продавец может принять Животное обратно, но без возврата стоимости и без замены Животного, или оказать помощь в поиске другого Покупателя.

 

4. Если Покупатель не воспользовался правом, оговоренным в п.2, то претензии по состоянию здоровья Животного в дальнейшем не принимаются. Замена Животного после 5-дневной гарантии, данной Продавцом, исключается. За дальнейшее здоровье Животного полностью отвечает Покупатель. 

 

5. На момент актировки Животного председатель клуба подтвердил, что дисквалифицирующих признаков Животное не имеет.    

 

6. Продавец гарантирует соответствие Животного качеству, указанному в настоящем Договоре, на момент продажи и не дает никаких гарантий на будущее относительно выставочной карьеры и репродуктивных качеств Животного. Продавец и Клуб не несут ответственности за продажу Животного с не выявленными дефектами, недостатками и генетическими заболеваниями, которые невозможно выявить на момент актировки.

 

7. Продавец обязуется оказывать консультационную помощь в вопросах содержания, воспитания, племенного разведения, подготовки Животного к выставке.

 

8. Животное никогда не может быть сдано в магазин или на рынок для перепродажи, приют для домашних животных, исследовательскую лабораторию. А также перепродано, отдано, сдано в аренду или подарено без письменного согласия Продавца с обязательным предоставлением ФИО и контактных данных (адреса, телефона) новых владельцев до момента передачи им Животного.

 

9. В случае нежелания или отказа Покупателя от дальнейшего содержания Животного Заводчик может принять его обратно. При этом сумма, потраченная на его содержание и приобретение, не компенсируется. 

 

10. Если Продавцу станет известно о продаже котят без документов в разведение от данного Животного, о плохом физическом состоянии или неухоженном состоянии Животного, либо о фактах жестокого обращения, Животное со всеми регистрационными документами подлежит немедленному возврату Продавцу без возмещения ранее уплаченных Покупателем средств. 

 

11. Покупатель обязуется добросовестно содержать Животное, обеспечивать рекомендованные Продавцом уход, сбалансированное питание, регулярную плановую вакцинацию и дегельминтизацию, исключить выход на незастекленный балкон, доступ к открытым окнам или неконтролируемый выход на улицу. Покупатель обязуется всегда обеспечивать Животному оказание своевременной необходимой ветеринарной помощи. Если ветеринарная помощь была оказана не своевременно, претензии по здоровью Животного Продавец не принимает.

 

12. Покупатель обязуется не содержать Животное в клетке, кроме случаев обязательного карантина, необходимость и причина которого должна быть подтверждена и доказана заключением государственной или частной лицензированной ветеринарной клиники.

 

13. Покупатель обязуется уделять Животному время для общения, обеспечивать его игрушками, не оставлять на длительное время без человеческой опеки. Животное должно иметь должный и присущий породе уход, надлежащий кормовой рацион, который включает употребление готовых сухих кормов не ниже Premium класса или качественное натуральное питание, рекомендованное Продавцом. В случае необходимости – своевременное и качественное ветеринарное обслуживание.

 

14. Покупатель обязуется не проводить Животному операцию по удалению когтей понимая, что эта жестокая операция приносит Животному увечье, отрицательно влияет на его здоровье и поведение.

 

15. В случае заболевания Животного Покупатель обязуется сообщить Продавцу и принять его рекомендации, а также показать животное ветеринарному врачу.

 

16. Если в доме Покупателя имеются другие животные, то для котенка обязателен трехнедельный карантин. При совместном содержании животных без карантинного срока претензии по здоровью котенка не принимаются.

 

17. Продавец и Покупатель имеют право использовать в рекламных целях фотографии данного Животного, как сделанные до его приобретения Покупателем, так и после, кем бы эти фотографии ни были сделаны, кроме тех, права на которые защищены.

 

18. Любая видео, фото и текстовая информация о Животном, публикуемая Покупателем в СМИ, на сайтах и форумах сети Интернет должна содержать полное имя Животного с обязательным указанием его племенной приставки.

 

19. Вся информация о деятельности питомника, полученная в результате общения Покупателя и Продавца (письменного и устного), признается сторонами конфиденциальной и не должна передаваться третьим лицам, освещаться в средствах массовой информации, интернет-ресурсах и форумах. 

Если возникают конфликтные ситуации, Покупатель не имеет права выносить их на публичное обсуждение - интернет, форумы, телевидение. Так же этого не могут сделать другие люди по просьбе (либо со слов) Покупателя. Конфликтные ситуации могут решаться только напрямую между Покупателем и Продавцом. В случае публичного скандала и (или) распространения сведений, порочащих репутацию Продавца и питомника SharmMuar, в том числе передачи информации третьим лицам, Продавец освобождает себя от всех обязательств, включая замену животного и любого рода компенсации. 

 

20. За нарушение любого пункта договора Покупатель обязуется выплатить Продавцу штраф в размере 2000 евро.

 

 

Для котят, проданных в разведение

 

1. Покупатель обязуется не спаривать кошку до 10 месяцев. Кошка может иметь не более 3 пометов за 2 года.

 

2. Животное приобретается с возможностью племенного использования как закрытый производитель. Данное Животное является закрытым для сторонних вязок. Вязки данного Животного должны происходить только в питомнике Покупателя с Животными, находящимися в полной собственности Покупателя.  Остальные случаи должны оговариваться с Продавцом данного Животного и происходить только с его письменного согласия.

 

3. Все котята, полученные в результате вязок данного Животного, не могут быть проданы, подарены, сданы в аренду, отданы в уплату за что либо, обменены, отданы в совладение и т. п. в Уральский регион – Челябинская, Свердловская области и Пермский край.

 

4. Любой потомок от данного Животного должен быть продан с Договором и Регистрационными документами

 

5. Все котята от данного Животного продаются в разведение только в зарегистрированные питомники имеющие хорошую репутацию, только как закрытые производители.

 

6. Покупатель обязуется не продавать в разведение котят от данного Животного в питомники: 

Silver Aqualion (Александрова Ирина), Еkb-coon (Алексеева Елена), Pet Palace (Шульгина Ирэна), DeniLars (Денисюк Лариса), LinaVanLinx (Иванова Эвелина), Sansaverina Gold (Репина Екатерина), Wariwat (Сарина Татьяна), PawWinner (Хлистунова Галина), Валентина Егорова (Полетаева). Этот запрет распространяется на последующую продажу любых потомков котят от данного Животного.

 

7. Котята, проданные под кастрацию от данного Животного, должны быть кастрированы до отъезда в новый дом.

 

8. Продавец (Барабаш А.В.) имеет право купить у Покупателя котенка от данного Животного с правом выбора любого пола и окраса по цене, не превышающей стоимость Животного, указанную в данном Договоре.

 

 

Оплата сделки

 

Стоимость Животного по настоящему Договору составляет …руб. (… рублей)

Расходы по отправке Животного в другой город / страну (включая ветеринарную справку, переноску, транспортные расходы) оплачиваются Покупателем дополнительно по отдельной договоренности и не входят в стоимость Животного.                                                                           

В случае отправки животного через курьера в другой город / страну, днем получения Животного считается день передачи Животного курьеру. Ответственность за жизнь и здоровье котенка берет на себя курьер по доставке.

При резервировании Животного Покупатель вносит невозвратный задаток в размере … руб. (… рублей)

Покупатель обязан оплатить оставшуюся стоимость Животного в размере …руб. (… рублей) за две недели до даты отправки Животного и забрать Животное до … (…).

 

• Если Покупатель не оплатил и не забрал Животное до указанного срока и не выходит на связь – Продавец вправе считать это отказом Покупателя от приобретения Животного. Животное может быть продано другому лицу без возврата залога Покупателю. 
• Если Покупатель не может забрать Животное в оговоренный срок, то предупреждает о данном факте Продавца в письменном виде. Содержание Животного в питомнике Продавца с (...) будет платным, из расчета 500 рублей за каждый день содержания.
• Продавец снимает с себя ответственность за жизнь и здоровье Животного с (...). Вся ответственность за жизнь и здоровье Животного переходит на Покупателя, несмотря на то, что Животное находится на платном содержании у Продавца.

 

 

Залог в случае отказа от Животного не возвращается.

Если по вине Продавца Животное не может быть передано Покупателю (гибель, травма либо другая причина), то залог не возвращается. Покупатель имеет право выбрать другое Животное такого же племенного класса и типа, либо оставить за собой право выбрать Животное от другой пары.
